In a decision released on September 4, 2012, Justice L.C. Leitch of the Ontario Superior Court of Justice approved the Settlement Agreement entered into with the Merck defendants. In her detailed reasons for decision, Justice Leitch concluded that she was satisfied that the Settlement Agreement is a fair and reasonable resolution of the this action and in the best interest of Class Members in all of the circumstances.

Vioxx Settlement — Ontario Approval Decision September 4, 2012
In addition. the Saskatchewan Court of Queen’s Bench has already approved the Settlement Agreement. A motion to approve the Settlement Agreement will be argued before the Quebec Superior Court on September 7, 2012.
